These Terms of Service govern the use of our website and the services provided by Agile Web Management.

Agile Web Management provides website design, hosting, and ongoing website management services to small businesses.

By using our website or engaging our services, you agree to these Terms.

2. Services

We offer:

  • Website build-only services
  • Managed website services on a subscription basis

Service details, pricing, and inclusions are outlined on our website and may vary depending on client requirements.

3. Managed Services & Contract Terms

  • Managed website plans are subject to a 12-month minimum term
  • Services begin once onboarding or build work has started
  • At the end of the contract term, clients may:
    • Renew their contract
    • Purchase the website outright (terms provided separately)
    • Cancel their contract resulting in the website being removed

4. Pricing & Payment

  • Prices are displayed on our website
  • Payments are due in advance unless otherwise agreed
  • Setup fees are payable before work begins
  • Late payments may result in suspension of services

5. Your Right to Cancel

  • Clients have the right to cancel within 14 days of payment and providing no work has been carried out, shall receive a full refund.
  • If Clients cancel after the website has been built but prior to the service management plan commencing, only the monthly fee will be refunded and the setup fee will be retained to cover the cost of work completed.

6. Client Responsibilities

Clients agree to:

  • Provide accurate information and content
  • Respond reasonably to requests needed to deliver services
  • Ensure they have rights to any content supplied

We are not responsible for delays caused by missing or inaccurate information.

7. Website Content & Ownership

  • For build-only services, full ownership transfers upon completion and payment
  • For managed services, ownership terms are defined by the contract
  • Clients may purchase the website at the end of a managed contract
  • Agile Web Management retains the right to showcase completed work in portfolios unless otherwise agreed

8. Updates, Changes & Support

  • Managed services include ongoing maintenance and updates as outlined in the chosen plan
  • Requests outside the agreed scope may incur additional charges
  • We aim to respond promptly but do not guarantee specific turnaround times unless agreed in writing

9. No Guarantees

While we work professionally and diligently:

  • We do not guarantee website traffic, rankings, leads, or revenue
  • Search engine performance and third-party services are outside our control

10. Limitation of Liability

To the fullest extent permitted by law:

  • We are not liable for indirect or consequential losses
  • Our liability is limited to the fees paid for the service in the preceding 12 months

Nothing in these Terms limits liability for death, personal injury, or fraud.

11. Termination

We reserve the right to suspend or terminate services if:

  • Payments are not made
  • These Terms are breached
  • Unlawful or abusive use occurs

12. Governing Law

These Terms are governed by the laws of England and Wales, and any disputes will be subject to their exclusive jurisdiction.
